Since very few of us have any idea of the Chinese laws on this issue, you won't get very good answers on that half of your question.
In the US, their program is legal. Yes, it's MLM, but there are no laws against these programs, since the acual earnings come from the sale of product. Ponzi schemes don't actually make money by sale of product, but by getting more and more people to buy into the program.

I'm not a guru in Chinese law, so I will only speak to the US law.
Multi-level marketing is legal as long as the revenue is not generated by sign-up fees. Amway used to have that practice, now you join by purchasing a starter kit. So they've gone from a flat fee to an initial purchase, which makes it within the law.

I am not in Amway, nor do I want to be, but to answer your question regarding it being legal in the USA, YES, it is legal! Most people just need educated on the system. Many people think negative about Network Marketing, however it's the fairest business plan on the planet. Some don't like the structure and have negative comments saying it's a pyramid. Just think about that word for a moment: A pyramid is the strongest structure known to man. It's on the back side of a $1.00 Bill. The Government is a pyramid. Why? The President is higher than the Vice President. The military is a pyramid and so is your job or career. Why? You have people in charge that are above you. Right? Sure you do! The word pyramid has nothing to do with a true and legal network marketing companies legitimacy. For real, it' the very best business blueprint available today. Period! I suggest you educate yourself, by seeing the plan I have at your convenience, then getting your questions answered, so that you can make an educated decision if the business is for you or not. 3. In a pyramid you cannot bypass, in income or position, the person that brought you in or sponsored you.
